Tesla FSD Regulations for the EU and UK: UNECE, DCAS and UN R171 Explained
If you follow Tesla Full Self-Driving (Supervised) in Europe or the UK, you might be interested in how the regulations work, who writes the rules, what all the terms mean, and most importantly when the rules will allow FSD on the roads in Europe, the UK and further afield.
This article takes those pieces in order, one section at a time. It is the first part of our Tesla FSD Regulations for UK and Europe series.
What is the UNECE and How Are Vehicle Regulations Made?
The United Nations Economic Commission for Europe (UNECE) is one of the five regional commissions of the United Nations. Although it was originally focused on Europe, its work on vehicle regulations now has global reach.
Within the UNECE, the World Forum for Harmonization of Vehicle Regulations (WP.29) is the body responsible for developing and updating international vehicle regulations. WP.29 manages three main agreements. The most important for type approval is the 1958 Agreement.
Under the 1958 Agreement, technical regulations are developed by specialised Working Parties. For automated and driver-assistance systems, the relevant group is the Working Party on Automated/Autonomous and Connected Vehicles (GRVA).
The process generally works as follows:
- Experts from governments and industry work in task forces and informal groups (for example the Task Force on ADAS).
- Draft regulations or amendments are discussed and refined in GRVA sessions.
- Once agreed, the text is submitted to WP.29 and its Administrative Committee (AC.1) for formal adoption.
- After adoption, a six-month period follows. If there are no major objections, the regulation or amendment enters into force.
- Contracting Parties that apply the regulation can then grant type approvals based on it.
GRVA is currently chaired by Germany, with vice-chairs from China, Japan and the United States. Final votes take place at WP.29 sessions in Geneva.
What is a Driver Control Assistance System (DCAS)?
A Driver Control Assistance System (DCAS) is the official UNECE term for advanced Level 2 systems that provide sustained lateral (steering) and longitudinal (acceleration and braking) control at the same time.
Under these rules:
- The driver remains fully responsible at all times.
- The system can maintain lane position, manage speed, and carry out certain manoeuvres.
- Continuous driver monitoring is required.
- The system must issue clear warnings or hand back control if the driver becomes disengaged.
Tesla FSD Supervised falls into this category. It is supervised Level 2 assistance. The driver must still pay attention and stay ready to take over.
Where Do the UNECE Rules Apply?
UNECE vehicle regulations under the 1958 Agreement do not automatically bind every country in the world. A country only has to apply a regulation if it is a Contracting Party to the Agreement and has chosen to apply that specific regulation.
For the DCAS rules that matter to FSD Supervised, around 60 Contracting Parties currently apply the relevant regulation. That list includes:
- The European Union (as a regional body) and all its member states
- The United Kingdom
- Japan
- Republic of Korea
- Australia
- New Zealand
- Switzerland
- Norway
- Turkey and many others
The United States and Canada are not part of the 1958 Agreement type-approval system. They use their own national frameworks instead.
Because so many major markets apply the same DCAS regulation, a type approval granted by one Contracting Party is generally recognised by the others under the mutual recognition principle of the 1958 Agreement. Live country status for Tesla FSD is tracked on our global map and EU Tracker.
UN Regulation No. 171: The Official Framework
The regulation that turns the DCAS concept into a formal type-approval rulebook is UN Regulation No. 171. It is the dedicated regulation written for Driver Control Assistance Systems. National type-approval authorities use it when they assess systems like Tesla FSD Supervised.
R171 was developed through the UNECE process described earlier, with detailed drafting in the Task Force on ADAS under GRVA. Official documentation is available on the UNECE vehicle regulations pages.
R171 sets uniform technical requirements covering:
- Functional performance
- System boundaries and Operational Design Domain
- Driver engagement monitoring (hands and eyes)
- System-initiated manoeuvres
- Controllability and driver override
- Software identification
- In-service monitoring and reporting
In Europe and the UK, it is this UN R171 regulation that gives Tesla’s FSD (Supervised) hope for approval.
Understanding the Series of R171: The Main Source of Confusion
UN R171 is not a single regulation as such. It has various series numbers. Each series is still R171. The series number tells you which version of the rulebook is in force.
- Series 00 (original version) entered into force on 22 September 2024. This was the first version of the DCAS regulation.
- Series 01 entered into force on 26 September 2025. It expanded the rules, particularly for system-initiated manoeuvres on highways and clearer driver-monitoring requirements.
- Series 02 was adopted in June 2026 and is expected to enter into force in late January 2027. It further widens the permitted capabilities, including system-initiated manoeuvres on non-highway and urban roads and broader conditions for hands-off operation.
Comparison of the Main UNECE Regulations
R171 is not the only UNECE regulation mentioned when people talk about Tesla automation. The table below summarises various UNECE regulations and how they apply to Tesla’s driver solutions, including Autopilot, FSD and Robotaxis.

Tesla FSD Supervised Netherlands Approval (April 2026)
On 10 April 2026 the Dutch type-approval authority RDW issued the first European type approval for Tesla FSD Supervised. That is the practical point where the R171 framework became a real customer-facing approval. Official information from the authority can be found on the RDW website.
Key facts:
- The approval was granted under UN R171 Series 01.
- Because certain capabilities of FSD Supervised exceed the baseline limits of Series 01 (particularly urban operation and more extensive system-initiated manoeuvres), RDW also applied Article 39 exemptions under EU Regulation 2018/858.
- Article 39 is the EU exemption for new technologies or new concepts that do not yet fully fit the harmonised type-approval rulebook.
- A manufacturer can apply when those features are incompatible with one or more of the usual regulatory acts.
- The national authority may then grant a provisional EU type-approval that is valid only in that member state first, provided the case for equivalent safety is made and the Commission and other member states are notified.
- That is why Article 39 was needed here: Series 01 of R171 does not fully cover everything FSD Supervised does in the field.
- One clear example is system-initiated manoeuvres beyond the narrower highway-focused envelope of baseline Series 01, including more complex urban use.
- Until a later series of R171 (such as Series 02) brings more of that capability into the standard text, the exemption fills the gap.
- The approval covers the European software version of FSD Supervised and applies to HW4 vehicles. There is no clear public evidence that HW3 is included in the same regulatory scope; that remains speculation.
So the Dutch decision is not a pure Series 01 approval with no extras. It is Series 01 plus exemptions. That combination enabled the launch in the Netherlands and started mutual-recognition discussions in other EU countries. Our Netherlands RDW approval coverage has more on that decision.
Where Things Stand Now
As of August 2026, the current situation for owners is promising. The Netherlands has a type approval under R171 Series 01 with Article 39 exemptions. Other countries are recognising that path, reviewing it, or waiting for a later series of R171. That is why the same product can look approved in one market and still under review in another.

What Comes Next
Series 02 of UN R171 is the next major milestone. After it enters into force in late January 2027, Tesla will be able to apply for a type approval under the expanded rules, however FSD will need some adjustments to fully comply.
