Musk Hopes for EU-Wide Tesla FSD (Supervised) TAD Approval by Q1 2027
21 October 2026. Elon Musk told investors on Tesla's third-quarter earnings call tonight that he would be surprised if EU-wide approval of FSD (Supervised) TAD takes longer than Q1, which would be early 2027. That's his hope rather than a regulator's date, though. FSD (Supervised) TAD is approved in 9 of the EU's 27 countries so far, and the vote that would open up the rest of the bloc needs a qualified majority of member states at a committee that hasn't voted on it yet.
He made the comment in his opening remarks, a few minutes after the call started at about 22:31 BST, rather than in answer to an analyst's question. He was also careful to add that the timing isn't something Tesla controls.
What did Musk say about EU-wide FSD (Supervised) TAD approval?
Musk brought Europe up shortly after saying that FSD (Supervised) is the biggest driver of demand for Tesla's cars. In clips of the webcast, his exact words were:
"We're now approved in many countries in Europe, and we're hoping for an EU-wide approval. It's hard to predict, but maybe within a few months, but I would be surprised if it takes longer than Q1. But obviously that's not a time frame we control, but we do anticipate being fully approved throughout Europe and many other countries."
The middle of that passage is where he hedged. He called the timing "hard to predict", offered "maybe within a few months" as the hopeful case and said himself that it's "not a time frame we control". I think Q1 is best read as the outer edge of what he's hoping for, not as a schedule. He only said "Q1", but as the call came after Q3 2026 had ended, the next Q1 runs from January to March 2027.
Tesla's written update for the quarter gives no EU date. It says Tesla believes FSD (Supervised) is driving demand where it's available and that it continues "to work with regulators to get it approved in other markets". The highlights Tesla posted on X list "4 new approvals since Q2 (Croatia, Slovenia, Czech Republic, Slovakia)" and say FSD is "now live in nine EU countries & used by over 100,000 customers". Tesla counts all nine as live, while the EU tracker shows the rollout has started in five of them, with the other four approved but still waiting.
Terminology
- FSD (Supervised) TAD. FSD stands for Full Self-Driving, and it's Tesla's driver assistance system. Tesla now calls the supervised version Tesla Assisted Driving (TAD) in Europe, which is why this article calls it FSD (Supervised) TAD. It isn't self-driving, because the driver stays responsible at all times.
- RDW type approval. This is the approval the Dutch vehicle authority, the RDW, granted for FSD (Supervised) TAD on 10 April 2026. It's a provisional approval valid in the Netherlands, and other member states can recognise it on their own territory.
- Article 39. This is the exemption route in EU type-approval Regulation 2018/858 for new technology that doesn't fit the existing rules. The RDW used it, and the Netherlands has asked for its approval to be authorised across the EU.
- TCMV. This is the Technical Committee on Motor Vehicles, where EU member states and the European Commission discuss and vote on that Dutch request.
- Qualified majority. This means at least 55% of member states, which is 15 of the 27, representing at least 65% of the EU's population.
- UN R171. This is the UNECE regulation for Driver Control Assistance Systems (DCAS), the rulebook FSD (Supervised) TAD is assessed against. Series 02 is the newer version of the regulation.
Which countries have approved Tesla FSD (Supervised) TAD?
"Many countries" is Musk's phrase, and the count behind it is 9 of the EU's 27 member states, according to the EU tracker. It started with the RDW type approval in the Netherlands in April. The other eight have followed nationally, although the rollout is only active in five of the nine so far.
| Country | Approved | Rollout |
|---|---|---|
| Netherlands | 10 April 2026 (RDW type approval) | Active |
| Lithuania | 20 May 2026 | Active |
| Estonia | 29 May 2026 | Active |
| Denmark | June 2026 | Active |
| Belgium | 10 June 2026 | Active |
| Slovenia | 7 September 2026 | Approved, rollout pending |
| Czech Republic | 21 September 2026 | Approved, rollout pending |
| Croatia | 29 September 2026 | Approved, rollout pending |
| Slovakia | 16 October 2026 | Approved, date not announced |
Statuses and dates come from the Not an FSD Tracker EU tracker, last updated on 17 October 2026.
The newest is Slovakia, the ninth EU approval, where the transport ministry recognised the RDW type approval on 16 October. Like Belgium's approval in June, it's a national decision that only applies on its own roads. None of the EU's four most populous countries is on the list yet, though. Electrek worked out in September that the first seven approvals added up to about 12% of the EU's population, and as Croatia and Slovakia are both small, I think the nine together still cover well under 65% of the EU population, although national approvals aren't TCMV votes in any case.
Is Tesla FSD (Supervised) TAD approved across Europe yet?
It isn't yet. Every approval so far is national, and the other 18 member states haven't approved it. The EU tracker shows that France opposes the system in its current form and wants technical changes and road tests first. Poland wants local testing, and Romania doesn't recognise the RDW type approval. In Sweden, the Swedish Transport Administration, Trafikverket, recommended in a June letter to the TCMV that it vote against EU-wide approval unless the ability to set a speed offset is removed, although the government said on 31 August that its ambition is EU-wide approval of systems like FSD (Supervised), after evaluations that can guarantee safety. Germany and Austria are tied to the EU process, and Germany's transport minister backs an EU decision. Italy looks likely to wait for it too, and Spain is waiting for the TCMV. You can see every country on the global FSD (Supervised) TAD approval map.
How does EU-wide approval work at the TCMV?
An EU-wide approval wouldn't be a fresh test of the car. It would be the EU authorising the existing RDW type approval across all 27 member states under Article 39, which is what the Netherlands has asked for. It would also mean owners in countries that haven't recognised it nationally wouldn't need a separate national decision. The TCMV has to back the request by a qualified majority of at least 15 member states representing at least 65% of the EU's population, and the Commission then has to adopt the decision. That's why approving nationally isn't the same as voting yes, and nine approvals aren't a voting majority. There's more on the steps after that in what happens after a TCMV yes vote.
When is the EU vote on Tesla FSD (Supervised) TAD?
There isn't a confirmed date yet. Reuters reported on 25 September that the agenda for the TCMV's 6 October meeting listed only a "continuation of discussions" on the Dutch request, even though Tesla had pointed to 6 October as a possible vote. The EU tracker shows the meeting ended without one. The next scheduled meeting is in December, which Reuters described as the earliest apparent opportunity for a vote, but no vote has been announced for it.
Could EU approval really come by Q1 2027?
It's possible, because a yes in December could land inside Musk's window, even though the Commission would still have to adopt the decision afterwards, but that depends on votes Tesla doesn't yet appear to have. Electrek calculated that Germany, France, Italy and Spain together hold about 58% of the EU's population, so the 65% threshold can't be reached without at least some of them, and France has so far opposed the system in its current form.
It's also worth setting Q1 against the last EU timeline Tesla gave. On the Q1 2026 call in April, Tesla's chief financial officer, Vaibhav Taneja, said the Dutch approval "sets us up well for an EU-wide approval later in Q2", and Musk said FSD (Supervised) TAD would go "to Brussels for EU review in May". That didn't happen, because the TCMV discussed the Dutch request in June and again on 6 October without voting. This time Musk wrapped his Q1 hope in more caveats, and I think the fairer reading is that national approvals are moving quickly, with Tesla counting "4 new approvals since Q2", while the EU-wide decision is still waiting on a vote that hasn't been scheduled.
Does UNECE R171 change Tesla FSD (Supervised) TAD's path in Europe?
Not directly, but it runs alongside the vote. The RDW type approval needed Article 39 because Series 01 of the regulation has a highway-only limitation on manoeuvres the system starts by itself. As the UNECE R171 Series 02 explainer sets out, Series 02 removes the highway-only limitation but adds new conditions, such as engagement checks before a manoeuvre, and keeps the rule, already in Series 01, that the system mustn't let the driver set a default offset above the detected speed limit. It's possible that rule bears on the speed offset setting Trafikverket objected to, but the regulation's wording is narrower than a ban on drivers choosing a higher speed. Late January 2027 is the working expectation for its entry into force, so it's possible a Series 02 approval becomes part of the story in Q1, but Musk didn't mention it, and it would still have to be applied for and granted.
What happens next for Tesla FSD (Supervised) TAD in the EU?
The next thing to watch is the December TCMV agenda, and whether it lists a vote on the Dutch request or another round of discussion, because that will say much more about Q1 than anything on an earnings call. In the meantime, I think it's likely more countries will recognise the RDW type approval on their own, as Slovakia did last week, and the EU tracker will be updated as they do.
