Slovenia Awaiting EU Decision on Tesla FSD Supervised: No Automatic Recognition of Dutch Approval
The Slovenian Traffic Safety Agency (Agencija za varnost prometa (AVP)) has provided an official update on its position regarding Tesla FSD (Supervised). In a detailed response, the Agency's Vehicles Department confirms it is actively monitoring procedures and discussions at both the individual Member State and European Union levels.
Dutch Approval Has Only Temporary Validity
According to the AVP, the Dutch type-approval authority RDW has granted approval for the FSD (Supervised) system “with temporary or limited validity.” The Agency notes that RDW itself has emphasized this does not constitute a self-driving or autonomous vehicle, but rather an advanced driver assistance system in which the driver remains responsible for driving and must maintain control of the vehicle at all times.
This aligns with the Agency’s previous communications and reinforces that the Dutch decision does not automatically extend to Slovenia or other EU Member States.
EU-Level Coordination Required
The Slovenian response highlights that advanced driver assistance systems and new vehicle technologies fall under Regulation (EU) 2018/858 on the approval and market surveillance of motor vehicles.
Specifically, the procedure under Article 39 is designed for new technologies or novel concepts not yet fully covered by existing technical regulations. Such cases require:
- A specific technical evaluation
- The exchange of information between Member States and the European Commission
- Coordination within the relevant European working bodies
The goal is to establish clear, comparable, and road-safety-appropriate conditions that apply uniformly or in a harmonized manner throughout the European Union.

Key factors will include the technical documentation, the conditions and limitations attached to any approvals, the findings of the competent type-approval authorities, and common European positions regarding the safe use of such systems in road traffic.”
