Awaiting EU Decision - No Automatic Recognition

The Dutch RDW approval for FSD Supervised has temporary or limited validity only and does not constitute automatic validity across EU Member States. The matter requires further technical evaluation and coordination at the EU level under Regulation (EU) 2018/858 (Article 39). FSD Supervised is an advanced driver assistance system; the driver must remain responsible and maintain control of the vehicle at all times.

“The Slovenian Traffic Safety Agency is monitoring the procedures and discussions related to the above-mentioned system, both at the level of individual Member States and at the level of the European Union. According to the information available, the Dutch type-approval authority, RDW, has granted approval for the FSD (Supervised) system with temporary or limited validity. RDW itself has emphasized that this does not constitute a self-driving or autonomous vehicle, but rather an advanced driver assistance system in which the driver remains responsible for driving and must maintain control of the vehicle at all times. With regard to your questions, we would like to clarify that advanced driver assistance systems and new vehicle technologies are addressed within the framework of the applicable European type-approval legislation, in particular Regulation (EU) 2018/858. ... The procedure under Article 39 of the aforementioned Regulation is intended for the assessment of new technologies or novel concepts that are not yet fully covered by existing technical regulations. Such procedures therefore require a specific technical evaluation, the exchange of information between Member States and the European Commission, and coordination within the relevant European working bodies. Regarding the possible wider deployment of the FSD (Supervised) system or comparable systems, we would therefore like to explain that further developments depend primarily on procedures and coordination at the EU level. ... Until the relevant European procedures have been completed and/or harmonized conditions have been established, it is not possible to prejudge the final outcome. The Agency will continue to monitor developments at both the EU and Member State levels and will act in accordance with the applicable legislation and the fundamental principle that the introduction of new technologies into road traffic must ensure a high level of safety for all road users.”
